  • Each properly registered User of this website: europebay.eu, gains access to functionalities, products and services, the possibility of making sales and purchases, and using other software and applications provided by MWqp - Group UG within the framework of providing the europebay.eu website.
  • Please remember that only real data of Users functioning online create credible, reliable and trustworthy identities, which nowadays are the basis for building honest and fully reliable relationships in communities existing and functioning both commercially and privately - online in the Internet space.

  • We encourage you to read the entire content of these Terms of Service, which, upon acceptance by the User, becomes an Agreement concluded with the User. We also encourage you to familiarize yourself with the information available via other Internet links on our website europebay.eu.
  • MWqp - Group UG provides services and sells its products on the terms and conditions set out in these Terms of Service through the europebay.eu website.
  • By expressing consent to the terms of the Agreement concluded with the User, the User fully accepts that the use of certain websites operated by MWqp - Group UG and europebay.eu may be governed by other Regulations. It is possible to conclude additional agreements with the User, inter alia, in connection with the operation of other confidentiality rules.
  • Each User who has the legal capacity to act, who registers on the europebay.eu website after accepting the content of these Terms and Conditions - fully accepts the content and the conditions contained in the Terms and Conditions for providing the europebay.eu website. It also accepts that any changes to these Terms and Conditions will be introduced at any time. MWqp - Group UG declares that it will take all possible measures to ensure that changes to the operation of the europebay.eu website have a negligible impact on the User's activity on the europebay.eu website. The User may be informed about the changes made in the form of an e-mail, to the address provided during the registration of the given User.
  • MWqp-Group UG, in the assumptions of providing up-to-date information contained in the Terms and Conditions, informs that work on the full and complete content of these Terms and Conditions will be completed by 01.05.2024. At the same time, MWqp-Group UG informs that this deadline may be changed if necessary and that the planned official launch of the europebay.eu service is scheduled for May 31, 2025. At the same time, MWqp-Group UG declares that its activities will be aimed solely at improving the security of Users' operation on the europebay.eu website and on the websites that cooperate directly with it.
  • MWqp-Group UG, as part of providing the europebay.eu website and the functionalities contained therein, does not become a contractual partner of any agreement concluded by the Consumer and the User through the europebay.eu website. Participants are obliged to resolve all disputes and problems that may arise as a result of operating on the europebay.eu website among themselves.
  • The provisions of this Agreement concerning Consumers and Users also apply to natural persons directly related to their business activities, even if it follows from it that it does not have a commercial character for them.
TERMS AND CONDITIONS of use of the europebay.eu website

§ 1. Definitions and Terms:

  • europebay.eu  - an open online trading website, available at the domain: www.europebay.eu, enabling the presentation of all kinds of offers in the internet space, operated and managed by the company: MWqp - Group UG with its registered office in Germany.
  • MWqp - Group UG  - MWqp - Group UG with its registered office in Germany, at Viktoriastraße 116, 47799 Krefeld, entered into the register of entrepreneurs kept by the District Court of Krefeld - Commercial Division of the National Court Register under number HRB 18639, Steuernummer: 117/5825/2087.
  • Registration  - the procedure of creating and establishing a new User Account through the forms available on the website operating under the domain: europebay.eu
  • User - means an entity or person who uses the services provided by MWqp - Group UG within the framework of operating an online trading platform called europebay.eu, on the terms set out in these Terms and Conditions - regardless of whether they are a private or business User.
  • Business User - means any entity, company or private person acting for commercial, commercial or professional purposes or any legal person who, through the services of the europebay.eu website, offers goods or services to consumers for purposes related to its business, commercial, craft or professional activities, having its registered office or place of residence in the European Union or outside the European Union, who, through the services of the europebay.eu website, offer goods or services to consumers located in the European Union or outside the European Union, regardless of other applicable provisions.
  • User Account - an individual place functioning on the europebay.eu website, maintained for each User separately by MWqp - Group UG under a unique User name (login), which account contains a set of information and resources collected by the User data together with all information about their activities within europebay.eu
  • Seller - a User who takes actions aimed at selling, transferring: goods, products or services as part of an offer presented through the online trading platform called europebay.eu.
  • Buyer / Consumer - a User who takes actions aimed at purchasing, acquiring: goods, products or services as part of offers presented through the website called europebay.eu.
  • Product / Goods - an item, thing, service or right being the subject of an offer is the subject of purchase or sale presented through the website called europebay.eu.
  • Offer - a proposal to conclude a contract for the sale of Goods (in particular containing the price and a detailed description of the Goods offered), on the terms specified by the Seller presenting the offer using the functionalities available within the website called europebay.eu.
  • Transaction - the procedure of concluding and performing a contract for the sale of offer, product, goods or services between Users within the europebay.eu website.

§ 2. Terms of Use for the europebay.eu Website:

2.1. Users may be natural persons aged 18 or over with full legal capacity, legal persons, or organizational units without legal personality but capable of acquiring rights and incurring obligations in their own name.
2.2. Natural persons who do not conduct business activities, on the europebay.eu website must register by completing the appropriate form, whereby:
2.2. /a. Full registration, subject to the provisions of Article 2.6 below, enables the use of all services provided by MWqp - Group UG via the europebay.eu website, including the purchase and sale of Goods (Standard Account),
2.2. /b. Users may be private individuals aged 18 or over to the extent that they can acquire rights and incur obligations in accordance with the provisions of applicable law, subject to the rules provided for them in their country of residence,
2.2. /c. If national law provides for the attainment of majority or limitations on legal capacity at a different age, the provisions of the law of the User's country of residence shall apply in this respect.
2.2. /d. Each new User, when registering, must complete the appropriate form, which requires the provision and entry of accurate and true data of the registering User - enabling the subsequent confirmation and verification of the above data by the customer service department of MWqp - Group UG - managing the europebay.eu website.
2.3. Legal persons conducting business activities and legal persons or organizational units referred to in Article 2.1 must register using the appropriate registration form by providing the data specified therein. Subsequently, these entities shall send to MWqp - Group UG a copy of documents confirming the aforementioned data on the business activity conducted. The obligation to submit copies of these documents applies to all Users who, as part of the Registration, have activated the Account by confirming the appropriate link in the e-mail received at the e-mail address provided in the registration form, from europebay.eu.
2.3. /a. MWqp - Group UG reserves the right to request additional declarations and documents confirming the conduct of business activities by entities that have their registered office, registered business, or actual place of business both within the European Union and outside the European Union outside the territory of the European Union.
2.3. /b. In the event that the documents referred to in the preceding sentence are drawn up in a foreign language other than English - also translations into English. Information on additional documents that the entities referred to in the preceding sentence will be required to submit will be contained in an e-mail sent by MWqp - Group UG after the User has completed the registration form.
2.4. An account registered in the manner referred to in Article 2.3 above, after positive verification of the data provided by the User, will be marked with an icon visible to all visitors to europebay.eu (Business Account). A User selling Goods as part of their business activity is obliged to carry it out exclusively through a Business Account. At the same time, a User using a Standard Account is obliged to immediately convert the Standard Account into a Business Account in order to start selling on the europebay.eu website in connection with the business activity conducted, subject to the condition that such conversion of the Account may only take place on the basis of applicable law. Thus, sales not related to the User's activity, referred to in the preceding sentences, take place within the framework of the Standard Account.
2.5. In the process of filling in the registration form, the registering entity provides the required data, and after filling in the registration form, depending on the method of registration and the type of data provided:
2.5. /a. A message will be sent to the e-mail address provided in the registration form indicating how to confirm the Registration and other information required by law;
2.5. /b. The registering entity may confirm the Registration using the available Registration confirmation mechanisms. Upon confirmation of the Registration, an agreement is concluded between the registering entity and MWqp - Group UG, the subject of which are the services provided via the europebay.eu website, on the terms and conditions set out in these Terms and Conditions
25. /c. By agreeing to the terms of the Agreement concluded with the User, the User fully accepts that the use of certain websites operated by MWqp - Group UG and europebay.eu may be governed by other Regulations. Additional agreements may be concluded with the User, inter alia, in connection with the operation of other confidentiality rules.
25. /d. MWqp-Group UG, by providing the europebay.eu website and the functionalities contained therein, does not become a contractual partner of any agreement concluded by the Consumer and the User through the europebay.eu website. The participants are obliged to resolve any disputes and problems that may arise as a result of the operation on the europebay.eu website between themselves.
2.6. In order to gain access to all services provided by MWqp - Group UG and functionalities on the europebay.eu website, the User must complete Full Registration, i.e. in addition to the obligation to send copies of documents, declarations or translations - as referred to in article 2.3 above (if applicable) - activate the Account, which can be done by: choosing one of the methods available to a given User, provided by MWqp - Group UG on the europebay.eu website or sent in the form of an email message to the registered User.
2.7. During Registration and subsequent use and operation on the europebay.eu website, the User is obliged to provide true data and information and to make - if applicable - truthful statements. A user of a Standard Account and a Company Account with an active Subscription service may add a photo or graphic to the Account, which may depict their present its image or logo ( awatar).
2.7. /a. In the case of logging in to the europebay.eu website or registering via external authentication services (e.g. offered as part of other services, including social networks), the User's data, including personal data and avatar (if it has been made available to the operator of this external service or website) will be transferred or disclosed to MWqp - Group UG and used in accordance with the provisions of these Regulations, and the User whose data is referred to in this point fully agrees to these actions.
2.7. /b. If an avatar is added, it will be assigned to the Account indicated by the User and registered in their name. In the case of logging in to the europebay.eu website or registering via external authentication services (e.g. offered as part of other services), the avatar transferred or disclosed to MWqp - Group UG by the operator of this external service or website will be assigned to the User's Account, in accordance with the email address provided by the User in this service or website. The User's avatar will be visible to other Users using the europebay.eu website during their selected activities within the operation of the europebay.eu website. The User whose data is referred to in this point fully agrees to these actions.
2.7. /c. An avatar will be assigned to the User's Account in the cases indicated above, provided that it meets the following technical requirements: minimum size 64x64px, file type: jpg, png and does not present any unlawful or inappropriate content, including in particular vulgar, obscene, erotic, pornographic, inciting hatred, racism, xenophobia. It is not permissible to include in the avatar content related to the User's activities conducted outside the europebay.eu website, as well as any contact details.
2.7. /d. The User is prohibited from deleting the data contained in the Account settings after completing the Registration, with the proviso that the User may at any time delete the avatar assigned to their Account. To delete the phone number, it is necessary to contact MWqp - Group UG using the available contact channels specified in these Regulations.
2.8. Users can access their Account on the europebay.eu website (login) by providing:
a login, email address, or phone number. Logging in to the europebay.eu website through automated solutions, using a mobile device's biometric data after enabling this function (biometric data is stored on the device and is not shared with MWqp - Group UG), or through external authentication services (e.g., offered by other services cooperating with MWqp - Group UG, including social media services) has the same effect as logging in directly to the europebay.eu website. Important! The use of automated solutions, especially external software that triggers login, is at the user's own risk.
2.9. A User may register more than one Account, provided that a different email address is assigned to each Account. A User with an active Subscription service may, when logging in to the europebay.eu website, grant selected functionalities related to the management of Transactions or Offers to a person duly authorized by the User. The Account User bears full responsibility for the actions and omissions of the duly authorized person related to the functionalities granted to them.
2.10. A User may not use Accounts to perform actions that violate the provisions of these Terms and Conditions. In particular, the following is prohibited:
2.10. /a. Performing a subsequent registration in order to avoid paying fees to MWqp - Group UG for services provided within the functioning of the europebay.eu website
2.10. /b. Entering into a purchase and sale agreement for Goods as part of one's own Offers, those of close relatives or persons cohabiting with the User, or other entities with whom the Buyer is in a relationship that gives rise to reasonable doubts that the parties are acting in collusion with the aim of influencing the outcome of the Transaction in a manner contrary to law or good morals,
2.11. The User shall not use the Accounts of other Users or make the Account available to other persons, except in the following cases:
2.11. /a. Making the Account available to a Company by persons duly authorized by the User to act on his behalf,
2.11. /b. Making the Standard Account available to the User's spouse by entering the spouse's data in the appropriate form. Spouses using the Account shall be jointly and severally liable for actions taken under that Account.
2.12. Accounts are non-transferable, subject to the consent of MWqp-Group UG:
2.12. /a. A Business Account may be transferred in the event that the User transfers to another entrepreneur the rights and obligations related to conducting a business or part thereof, in the form provided for by the law of the Country in which the business is registered.
2.12. /b. A Standard Account may be transferred by the User to their spouse.
2.12. /c. A User using a Standard Account may change the type of Account to a Business Account solely for the purpose of making sales and purchases within the framework of operating on the europebay.eu website after completing the appropriate form available on the europebay.eu website.
2.13. In the event that the User's Account or activity within the framework of operating on the europebay.eu website requires additional verification of the data referred to in art. 2.1. or 2.3, or if MWqp-Group UG has reasonable concerns regarding the security of the Account or Transactions, in particular regarding the unauthorized takeover of the Account by another person, or in the case of a breach of the Regulations by the User, MWqp-Group UG may:
2.13. /a. Make the use of the europebay.eu website or individual services provided within the framework of operating on the europebay.eu website dependent on the User's confirmation of their credibility, including identity, with appropriate documents,
2.13. /b. Temporarily restrict access to individual services provided within the framework of operating on the europebay.eu website,
2.13. /c. Suspend the User's Account for a specified or unspecified period,
2.13. /d. Apply mechanisms or tools blocking the operation of bots or other IT or programming tools,
2.13. /e. Upon cessation of the aforementioned circumstances, MWqp-Group UG shall lift the relevant restrictions imposed on the User.
2.14. Within 14 days of entering into the agreement referred to in Article 2.5, the User may withdraw from it without giving any reason. The rules for withdrawing from the agreement, including a sample withdrawal form that the User may use, are specified in the information, which constitutes Annex No. 1 to the Regulations. The right to withdraw from the agreement referred to in this point does not apply to the User who has placed an Offer, used the Buy Now option or has any outstanding debts to MWqp-Group UG, for services provided as part of the operation of the europebay.eu website.

2.15. The User acknowledges that assigning an avatar to their Account may involve the automatic adjustment of the avatar's size to the technical requirements defined by MWqp-Group UG.
2.16. 2.16. MWqp-Group UG employs mechanisms aimed at ensuring an appropriate level of security for Transactions and other services provided within the functioning of the europebay.eu website used by the User.
2.17.The execution of transactions and other services is only possible under the condition of ensuring their appropriate level of security. Detailed information about technical requirements, including current updates and recommended security measures - necessary for using the services provided by MWqp-Group UG, is available on the europebay.eu website, in this Terms of Service, or via email sent to the User at the email address provided during the User's registration.
2.18. The User should regularly update their data in their account settings, including contact details. The User of a Company Account should regularly check for new correspondence from MWqp-Group UG within the functioning of the europebay.eu website.

§ 3. Transactions / Offers

3.1. Within the framework of operating on the europebay.eu website, the Seller, by defining the terms of the Offer, may provide Buyers with the following modes of concluding a sales contract:
3.1. /a The "Buy Now" option, under which the Seller offers to sell the Goods at a predetermined price. This offer may include one or more items of Goods,
3.1. /b Advertisements - the purpose of Offers presented within the advertisement categories "Cars", "Real Estate", "Vacations", "Live Animals", "Machinery", "Trailers", "Other Vehicles and Boats", "Motorcycles and Quads", "Services" and "Tickets" is not to conclude an agreement between Users. These Offers are exclusively of an advertising nature. Offers referred to in this point cannot include more than one item of Goods.
3.1. /c. Offers referred to in this article may be presented by entities cooperating with MWqp-Group UG on the basis of separate agreements, in particular within the framework of services or internet applications (including mobile applications) operated by them.
3.3. MWqp-Group UG applies default sorting of Offers within the list of Offers, which adjusts the order of their placement taking into account the preferences of Buyers (Relevance):
3.3. /a. When combining Offers for the same Product using the appropriate functionalities on the website www.europebay.eu, the default Relevance method is applied to select the offer representing the given Product.

3.4. Within the functioning of the website europebay.eu, in addition to the default sorting by the "Relevance" criterion, the User has the possibility of selecting the following types of sorting Offers within the Offers list, i.e.:
3.4. /a. Price: from the lowest. It takes into account the following criteria in the following order: highlighting the Offer in the listing, matching the Offer to the searched phrase and category, the lowest price, the highest popularity, the shortest time to the end of the Offer;
3.4. /b. Price: from the highest. It takes into account the following criteria in the following order: highlighting the Offer in the listing, matching the Offer to the searched phrase and category, the highest price, the highest popularity, the shortest time to the end of the Offer;
3.4. /c. Popularity: the highest. It takes into account the criteria in the following order: highlighting the Offer in the listing, matching the Offer to the searched phrase and category, the highest popularity, the shortest time to the end of the Offer;
3.4. /d. Shortest Time Remaining: Least. Considers criteria in the following order: listing highlight, offer match to search phrase, shortest time until offer ends, offer number;
3.4. /e. Newest Added: Newest. Considers criteria in the following order: listing highlight, offer match to search phrase, shortest time since offer was published, longest time until offer ends;
3.4. /f. Shortest Distance: Shortest distance. Considers criteria in the following order: listing highlight, offer match to search phrase, shortest distance of the offer, offer number;
3.4. /g. Longest Distance: Longest distance. Considers criteria in the following order: listing highlight, offer match to search phrase, longest distance of the offer, offer number;
3.4. /h. Lowest Relevance: Lowest. Considers criteria in the following order: listing highlight, offer match to search phrase, lowest search relevance of the offer, offer number;
3.4. /i. Highest Relevance: Highest. Considers criteria in the following order: listing highlight, offer match to search phrase, highest search relevance of the offer, offer number;

§ 4. Prohibited and Conditionally Permitted Goods

4.1.
The Seller undertakes not to list any offers, goods, or services, the trade of which violates applicable laws (including the provisions of any foreign law that may apply in a given case) or the rights of third parties (in particular, copyrights and other intellectual property rights), as well as those the listing of which may be considered a violation of good morals. The Seller cannot sell Goods and services in a given country or undertake any activities related to sales in that country if it is contrary to the applicable and binding laws of that country. It is forbidden to publish and present any content that violates generally accepted ethical, moral, or social norms, in particular inciting or promoting hatred, violence, or any form of discrimination, including on grounds of nationality, skin color, beliefs, religion, worldview, promoting authoritarian and totalitarian systems, as well as any content praising or supporting such behavior or systems.
4.2. Notwithstanding the provisions of Article 4.1, it is forbidden to offer items listed as prohibited in Annex No. 2 to the Regulations.
4.3. The items referred to in Articles 4.1 and 4.2 cannot be offered together with Goods as a free gift.
4.4. Offering certain types of Goods requires meeting additional conditions, specified in Annex No. 2 to the Regulations.


Annex No. 2
The following Goods may not be the subject of the Offer:

1. containing grossly pornographic content;
2. symbols or products containing the symbolism of a fascist or other totalitarian state system or presenting content praising or promoting such a system or inciting hatred on the grounds of nationality, ethnicity, race, religion or lack thereof, or otherwise violating the prohibition referred to in Article 4.1 of the Regulations - excluding goods of artistic, educational, collectible or scientific value;
3. violating the personal rights of third parties;
4. music, films, software and other Goods that infringe intellectual property rights;
5. non-original products (so-called counterfeits, items infringing industrial property rights);
6. explosives and hazardous chemical substances;
7. narcotics, psychotropic substances, intoxicating substances, cannabis seeds;
8.
prescription drugs and other medicines, subject to conditionally permitted goods;
9. alcoholic beverages, subject to conditionally permitted goods;
10. tobacco products, electronic cigarettes, bases for liquids/flavours, liquids (including those without nicotine), spare containers and their parts, tobacco heaters and their parts, nicotine pouches, subject to conditionally permitted goods;
11. human or animal organs;
12. live or dead animal specimens (as well as their parts or by-products), only possible with reservation of offers to  conditionally permitted offers;
13. dogs and cats introduced into the market outside their breeding places or farms, and animals without a pedigree or metric, only possible with reservation of offers to conditionally permitted goods;
14. shares in companies, stocks, bonds and other securities, receivables, units of investment fund units, insurance policies and products, and all other financial instruments offered as a form of investment or placement of funds, with the exception of securities in physical form with only a collector's value, only possible with reservation of offers to conditionally permitted goods;
15. virtual currencies within the meaning of - cryptocurrencies - such as bitcoin, litecoin, dogecoin, etc.) and related services and products;

16. software infringing the manufacturer's license, in test version, freeware, shareware, and the like;
17. Software designed to perform activities that violate laws or good morals;
18. Addresses of websites and FTP servers (excluding internet domains);
19. information and instructions that are not of a service nature, in particular: advice on circumventing regulations, using online systems offering financial benefits (e.g., payment for displaying banners or receiving e-mail, information such as: how to do..., how to find..., how to earn...);
20. Access to torrent websites, accounts on free internet services and related services (e.g., likes, reviews, comments);
21. Access to erotic/pornographic websites and virtual currencies used in such services;
22. Accounts in affiliate and loyalty programs and services related to such programs;
23. Databases (including personal data or email lists);
24. Mail-order and direct sales catalogs for ordering goods, except for outdated catalogs with only collector's value;
25. Cyfra+, Cyfrowy Polsat, NC+ cards and devices owned by owned by other television platforms;
26. Master's theses, diploma theses, bachelor's theses, matriculation exams, essays and other similar works and services related to the creation of such works;
27. Stock market investment systems and systems for number games and bookmaking, as well as services related to providing assistance in participating in such games and placing such bets, except for official book publications with an assigned ISBN number;
28. fishing gear and equipment, the possession of which is restricted by law;
29. firearms and ammunition within the meaning of the Act on Firearms and Ammunition, subject except for the conditionally admitted offers;
30. registration certificates and vehicle cards offered without the vehicles to which they were issued and vehicles without documents, Polish registration plates (including vintage ones);
31. discount coupons, in the form of a promise entitling the holder to a discount or other benefit on a future purchase of Goods outside of europebay.eu,
32. electronic publications (e.g., books, poems, guides, so-called e-books) listed outside the "Ebooks" category;
33. gold in the form of bullion and their copies and imitations, coins minted after 1800  or gold scrap, and silver in the form of bullion and their copies and imitations, and scrap except for the conditionally admitted offers;
34. prepaid payment cards;
35. registered prepaid phone cards;
36. counterfeit currency remaining in circulation (counterfeits/imitations of Polish and foreign currency);
37. Used goods that should not be reused for health or hygiene reasons. This applies to items listed in the categories:

Any codes, passwords, tokens, keys, or accounts (hereinafter collectively referred to as "Codes") that enable access to and use of services allowing on-demand viewing or listening to multimedia content via the internet, in particular in the form of music, podcasts, and films such as Netflix, HBO Go, Cda Premium, VOD.pl, Player.pl, Spotify, Tidal, Storytel, except for Codes offered by entities conducting official, authorized resale activities under individual agreements concluded with europebay.eu;
39. All types of codes and coupons, in any form, in particular vouchers (hereinafter collectively referred to as "Vouchers"), which are exchangeable for a ticket or tickets to a film screening in a cinema or other services or products offered in cinemas or for use in cinemas, except for Vouchers offered by entities conducting official, authorized resale activities under individual agreements concluded with europebay.eu;
40. Firecrackers;
41. Live specimens of plants and animals recognized as posing a threat to the European Union, specified in the list of invasive alien species established pursuant to Regulation (EU) No 1143/2014 of the European Parliament and of the Council of 22 October 2014 on the prevention and management of the introduction and spread of invasive alien species;
42. Any form of permanent or temporary access to or use of an account or other set of resources (similar to accounts) in any online service, program or application, enabling the operation and playing of computer games, console games or mobile games or including other functionalities and services related to these games, such as their purchase, installation, storage, reviewing, tracking statistics, such as Steam, Epic Games Store, GOG, Ubisoft Connect, Origin, PlayStation Network, Xbox Live. The prohibition referred to in this point 42 does not apply to the sale of accounts or other sets of resources in any online service, program or application that enable the use exclusively on a customer basis of computer games, or console games or mobile games, the use of which is free of charge for all persons at all times;
43. Any and all services or functionalities that are offered or performed through an account or a set of resources referred to in point 42 above;
44. In vitro diagnostic medical devices (e.g., for SARS-CoV-2 coronavirus infections) not intended for self-testing and devices other than the remaining exceptions referred to in Article 10(2) of the Act of May 20, 2010, on Medical Devices;
45. Slot machines (gaming machines) within the meaning of the provisions of the Act of November 19, 2009, on Gambling;
46. New (subject to Article 2(24) below) and used software delivered electronically (ESD) offered within the category Electronics > Computers > Software;
47. OEM licensed software offered within the category Electronics > Computers > Software;
48. Used goods that should not be resold for safety reasons. This applies to items offered in the category Automotive > Chemistry (excluding the subcategory Automotive > Chemistry > Washing and care > Tools and accessories)
49. Containing terrorist content within the meaning of Regulation (EU) 2021/784 of the European Parliament and of the Council of 29 April 2021 on addressing the dissemination of terrorist content online.  
44 Conditionally permitted goods - listing the following types of Goods within Offers is permitted, provided that these items meet the conditions specified below and the description of the Goods posted on the Transaction page contains the indicated content (Conditionally permitted goods):
44  /1. Animals other than those listed in Annex 2 items 12 and 13 above.
Condition: The Seller must guarantee safe and humane transport conditions (preferably personal collection).
Required description elements: A statement guaranteeing safe and humane transport conditions.
44 / 2. Tobacco products.
Condition: They must be exclusively of collector's value.
Required description elements: A statement about the exclusively collector's value of the Goods.
44 / 3. Decoders for Cyfra+, NC+ and Cyfrowy Polsat, and decoders of other digital commercial companies providing television programs through them.
Condition: They cannot be the property of companies providing television programs through them.
Required description elements: Provision of the decoder's serial number.
44 / 4. Audiobooks and video books that are not official publications.
Condition: The Seller must be the sole author of the publication or its publisher.
Required description elements: Provision of the ISBN number assigned to the publication, located in the online database of the relevant Library.
44 / 5. Tickets for artistic, entertainment, or sporting events. Condition: They may only be offered in the "Tickets" category by entities cooperating with MWqp-Group UG based on separately concluded agreements, with the reservation that this does not apply to Advertisements displayed as part of the operation on the europebay.eu website.
44 / 6. Warranty cards. Condition: They cannot be a separate item for sale (they must be attached to Goods covered by the warranty).
44 / 7. Pepper sprays. Condition: They may only be offered in the "Pepper sprays" category by points holding a license to sell products intended for military or police use. Required description elements: Providing information about: the name of the gas, concentration, and composition.
44 / 8. Stun guns (incapacitating devices using electrical energy). Condition: They may only be listed in the "Stun guns" category by points holding a license to sell products intended for military or police use. The average current in the circuit may not exceed 10mA, and the energy may not exceed 300mJ. Required description elements: Providing information about: the name, current intensity, and manufacturer. A statement about the average current in the circuit not exceeding 10mA and energy not exceeding 300mJ. A statement with the following content: according to which the sale of such products is subject to registration, and the Seller is obliged to keep records of concluded Transactions. Incapacitating devices using electrical energy may only be sold to adults after identity verification.
44 / 9. Firearms and their essential parts. Condition: Muzzle-loading firearms (not for cartridge ammunition) manufactured before 1885 or their replica. Required description elements: A statement that the muzzle-loading firearm or its essential parts were manufactured before 1885 or are a replica.
44 / 10. Ammunition (e.g., projectiles, mines, grenades) or its essential parts. Condition: The ammunition is devoid of combat capabilities. Required description elements: A statement that the ammunition is devoid of combat capabilities.
44 / 11. Airguns. Condition: The projectile energy may not exceed 17 J. Required description elements: A statement that the projectile energy does not exceed 17 J.
44 / 12. Mushrooms. Condition: A certificate issued by a classifier or mycologist (excluding cultivated mushrooms and those placed on the market in other EU countries). Required description elements: A statement that the offered mushrooms have the appropriate certificate and attaching to the Offer (its description) a file in electronic form containing the certificate or a clear photo of the label containing the information required by law.
44 / 13. Pyrotechnic materials other than those mentioned in Art. 1 point 40 above. Condition: They may only be offered in the "Fireworks" category by points holding a license, with the reservation that their delivery cannot be provided by the following entities: GLS, Poczta Polska, Pocztex, Deutsche Post, DB Schenker, DHL, X-press, DPD. Required description elements: Providing information about the name of the manufacturer or importer, approval mark, or product certificate.
14. Goods within the "Investment Products" and "Collectible Gold Coins" categories. Condition: They may only be offered by entities operating under separate agreements concluded with MWqp-Group UG, whereby within the "Investment Products" category, only Goods in which precious metals constitute at least 50% of their value may be offered. Seller:
14/a. Within a Business Account, must have a recommendation rating of at least 98% on their Account. The shipping time of the Goods specified by the Seller in the sales form may not exceed 24 hours;
14/b. Within a Regular Account, must have a recommendation rating of at least 99% on their Account. The shipping time of the Goods specified by the Seller in the sales form may not exceed 24 hours. At least 3 months have passed since full Account activation.
14/c. After positive verification, i.e., fulfilling the requirements described in point a) or b), the Seller has the right to create a new account dedicated only to sales in the aforementioned categories.
15. Goods within the “GSM Accessories” – “Antennas and Amplifiers” category. Required description elements: Providing information that: “Independent installation and use of GSM/UMTS/LTE amplifiers, also known as repeaters, by unauthorized persons is legally prohibited. Only mobile network operators have the right to install this type of equipment. Failure to comply with the above may be considered an act punishable by a fine, and in the case of persistent action, by restriction or deprivation of liberty.”
16. Solid fuel boilers (furnaces). Condition: A certificate (solid fuel boiler test certificate) confirming the possibility of placing the boiler on the market in accordance with European standard EN 303-5:2012. Required description elements: attaching to the Offer content (in its description) an electronic file containing the certificate or a clear photograph of it.
17. Plants intended for planting and seeds, as referred to in Regulation (EU) 2016/2031 of the European Parliament and of the Council of 26 October 2016 on protective measures against pests of plants, amending Regulations (EU) No 228/2013, 1  (EU) No 652/2014 and (EU) No 1143/2014 of the European Parliament and of the Council and repealing Council Directives 69/464/EEC, 74/647/EEC, 93/85/EEC, 98/57/EC, 2000/29/EC, 2006/91/EC and 2007/33/EC. 2  Condition: Attaching a passport authorizing its movement, issued by an authorized registered entity, to each sent plant or seed. Required description elements: A statement with the following content: “I declare that, in accordance with Regulation (EU) 2016/2031 of the European Parliament and of the Council of 26 October 2016 on protective measures against pests of plants, amending Regulations (EU) No 228/2013, 3  (EU) No 652/2014 and (EU) No 1143/2014 and repealing Council Directives 69/464/EEC, 74/647/EEC, 93/85/EEC, 98/57/EC, 2000/29/EC, 2006/91/EC and 2007/33/EC, 4  a passport is attached to each plant or seed.

18. Goods within the /Fuels/ category. Condition: May only be offered by Users who have registered a Business Account and hold licenses for trading in liquid fuels (OPC). Requirements: conclusion of a separate agreement with MWqp-Group UG.
19. Vouchers that are redeemable for medical services provided remotely, using chat or teleconsultation. Condition: May only be offered in the /Telemedicine/ category by entities cooperating with MWqp-Group UG based on separately concluded agreements.

20. Courses, training sessions, workshops conducted remotely. Condition: May only be offered in the /Online Courses/ category by entities operating, among others, in the field of education and cooperating with MWqp-Group UG based on separately concluded agreements.

21. Restricted explosive precursors - within the meaning of Regulation (EU) 2019/1148 of the European Parliament and of the Council of 20 June 2019 on the marketing and use of explosives precursors, amending Regulation (EC) No 1907/2006 and repealing Regulation (EU) No 98/2013. Condition: They may only be offered by Users who have registered a Company Account and have listed in the Offer content each of the precursors contained in the Goods being the subject of the Offer, as well as the concentrations in relation to each of these precursors.
22. Regulated explosive precursors - within the meaning of Regulation (EU) 2019/1148 of the European Parliament and of the Council of 20 June 2019. on the marketing and use of explosives precursors, amending Regulation (EC) No 1907/2006 and repealing Regulation (EU) No 98/2013. Condition: They may only be offered by Users who have listed in the Offer content each precursor contained in the Goods being the subject of the Offer, and the concentrations with respect to each of these precursors.
23. Medical devices (e.g., pulse oximeters and thermometers). Condition: CE marking with the four-digit notified body number, labeling in Polish, and instructions in Polish. Required description elements: including in the Offer content (in its description) a clear photo of the CE marking with the four-digit notified body number, labeling in the language of the country for which the offer is intended, and information about including instructions in the language of the country for which the offer is intended.
24. New software delivered electronically (ESD) is listed under the category Electronics > Computers > Software. Condition: It may only be offered by entities cooperating with MWqp-Group UG based on separately concluded agreements.
25. DVB-T2 terrestrial television decoders (tuners). Condition: They must meet the technical and operational requirements for digital receivers, which should be specified in the national regulations of the country for which the offer is intended. Key description elements required: Providing information that the decoder (tuner) operates in the declared standard; in the case of a receiver with internet connectivity, that it supports hybrid television in the appropriate standard.


§ 5. Transaction Initiation

5.1.
The Seller creates an Offer by completing the sales form available on the website: europebay.eu, thus defining all the terms and conditions of the Transaction. The information contained in the Offer may only concern its subject matter.
5.1. /a. Upon introduction of information or data into the content of the Offer, MWqp-Group UG acquires the right to use them, in particular to use them in any way, at any time, at its own discretion. The Seller authorizes MWqp-Group UG to translate the Offer and its elements (including by means of software for automatic text translation) into other languages, as well as to display it in other languages.

5.1. /b. By posting information or data in the content of the Offer, the Seller declares that he/she is entitled to introduce them into the content of the Offer, and that their use within the operation on the website: europebay.eu and by MWqp-Group UG – in particular in the manner specified in the preceding sentences – does not infringe the rights of third parties. The Seller bears full responsibility for the truthfulness of the declaration referred to in the preceding sentence.
5.2. The content of the Offer should be reliable and complete and may not mislead other Users, in particular as to the characteristics of the Goods, such as: its condition, parameters, quality, origin, brand or manufacturer.
5.2. /a. The content of the Offer should comply with legal requirements, in particular contain information resulting from applicable regulations regarding consumer protection and in no case may suggest the use of the Goods in a manner that violates applicable law. The Offer description may not contain any content that is inconsistent with applicable law. The User bears full responsibility for the content placed by him/her in the Offer, including responsibility for any errors or inaccuracies therein. The Seller declares that he/she is entitled and has the ability to conclude and perform a contract with the Buyer.
5.3. By performing the actions referred to in Articles 5.1 and 5.2, the Seller commissions the Company to publish the Offer on the date indicated by them. If the date has not been specified, the offer will be published as soon as possible, which date is generated automatically. The number of simultaneously published Offers by the Seller may not exceed 2000 without the Company's consent. The number of Offers by the Seller regarding the same Product, published within the same subcategory (regardless of the number of Accounts held by that Seller), may not be greater than 3, however, this restriction does not apply to Products whose condition is marked with a parameter other than “New”.
5.4. From the moment the Offer is published, the Seller is bound by its content. The Seller may make changes to the content of the Offer until the first offer is made by the Bidder. In the case of an Offer with the Buy Now option, the Seller may not effectively change its content towards Buyers with whom they have concluded a sales contract within the Offer. It is forbidden for the Seller to make changes to the content of the Offer that constitute a change to the offered Product or its properties. Upon introducing content to the Offer (publication on the europebay.eu website) that constitutes subject matter of copyright protection, in particular trademarks, logos, image, description and photos ("Content"), the User authorizes MWqp - Group UG to use this Content free of charge, non-exclusively, unlimited in time and territory, to the following extent:

5.4. /c. Public: exhibition, display, playback, broadcasting and retransmission;
5.4. /d. Lending and placing on the market.
5.4. /e. The User's consent also includes the creation of derivative works of the Content by MWqp - Group UG and the use of these derivative works to the extent that the Company is entitled to use the Content, and to grant further consents to the extent corresponding to the consent granted to MWqp - Group UG.
5.4. /f. The User consents to the exercise of moral rights to the Content by MWqp - Group UG and declares that they will not exercise these rights against MWqp - Group UG and entities to which MWqp - Group UG grants further consents to use the Content.
5.4. /g. The User guarantees that they are entitled to make the above declarations and grant the consents covered by the Regulations and to introduce the Content into the Offer, and that the Content and the use of the Content by MWqp - Group UG in accordance with the Regulations does not infringe the rights of third parties. The User shall indemnify MWqp - Group UG and entities to which MWqp - Group UG grants further consents to use the Content from any liability arising from the use of the Offer Content in accordance with the Regulations.
5.5. Detailed rules regarding the creation of the Offer, including determining its content, posting photos and using additional options regarding its presentation and promotion on the europebay.eu website are specified in Annex No. 3 to the Regulations.


Attachment No. 3: Rules for creating an Offer description;

Z 3.1. To create an Offer description, the Seller completes the sales form available on the appropriate europebay.eu website, where they must, in particular, fill in the Offer title, the Item description, specify the category corresponding to the Item's specifics, and the type and method of conducting the Transaction (including specifying the Offer duration and, according to their choice: specifying the starting price, optionally a minimum price, and indicating whether the Buy Now option should be included) and payment terms. The Offer description should be supplemented with at least one photo presenting the offered Item. In the sales form, the Seller may also, by selecting additional options, establish a special way of presenting and promoting the Offer on the europebay.eu website.
Z 3.2. It is forbidden to include in the Offer description content that violates the law, the MWqp-Group UG Regulations, as well as words, expressions, or phrases that have been used contrary to accepted moral standards (with the reservation of the nature of the Erotica category) and drastic content.
Z 3.3. Provisions essential for the Offer should be entered in text form in the language of the given country. It is permissible for the User to present content in the Offer that is stored on external servers (not belonging to MWqp - Group UG), however, this cannot be essential content.
Z 3.4. Only information regarding the offered Goods may be placed in the Offer's /Description/ field, its title, and parameters, however, in the /Description/ field it is permissible to include additional information about the manufacturer of these Goods and to provide information about other Goods available within the Offers of a given Seller.
Z 3.5. Other information should be placed in the appropriate tabs (details regarding delivery in the /Delivery and Payment/ tab, warranty conditions in the /Warranty/ tab, a description of the complaint procedure in the /Complaints/ tab, information regarding withdrawal from the contract without giving a reason in the /Returns/ tab, information about the seller in the About the Seller/ tab). If any value in the Offer's /Parameters/ field is not completed by the Seller or is completed with an ambiguous value (e.g.: Other, Others, Other brand, Other color, Other type, Other material, Other manufacturer, Other size, Other pattern, Other shape, Other number, Other value, Other use, Other sleeve, Other diameter, Other format, Other width, Other cut, etc.), individual data in this field may be supplemented by the Company based on appropriate, unambiguous information provided by the Seller in other fields of the Offer.
Z 3.6. MWqp - Group UG shall inform the Seller about the change made by it, as referred to in the preceding sentence, allowing the Seller to withdraw it by editing the offer. Subject to the exceptions provided for in the remaining provisions of the Regulations, contact details should be placed only in the designated areas. The above rules do not apply to Offers for which separate agreements with entities cooperating with MWqp - Group UG may specify different conditions regarding their description and the regulations contained therein.
Z 3.7. When creating an Offer presented ultimately on the europebay.eu website, the Seller should define the /Condition/ parameter of the Goods in accordance with the following characteristics: New - means Goods that are completely new, unused, unopened, not repackaged, undamaged, without any signs of use, in their original packaging (where applicable) with undamaged manufacturer's markings (such as seals on boxes or tags on clothes). Used - means Goods that have been previously used, may show signs of wear and tear, but are fully functional and work as intended. The Goods may be missing some parts or other accessories, such as screws (in the case of furniture) or a headset (in the case of a phone). Not damaged - means Goods that are fully functional and work as intended by the manufacturer. Damaged - means Goods or an element thereof that is not fully functional and does not work as intended by the manufacturer. The Goods may be missing some parts - this includes elements that are defective in a way that hinders use, elements requiring service, repair, or elements that are missing basic parts.
Z 3.8. Photos posted in the Offer must relate exclusively to the offered Goods - the Offer. It is permissible to present the Goods in the context of their application or arrangement. Photos may present certificates, technologies, graphic elements (e.g., arrows). Captions are prohibited, with the following exceptions: brand/manufacturer logo, color and pattern markings, and numbers and units.
Z 3.9. Banners on the offer list may not contain advertisements, promotional or advertising content relating to activities conducted outside the europebay.eu website, or contact details. The brand/manufacturer logo is permitted.
Z 3.10. The background photo is used to graphically represent the business profile and the type of assortment sold through the europebay.eu website and may not contain contact details, promotional or advertising content relating to activities conducted outside the europebay.eu website. It is permissible to provide the login and a short information about the business profile within the operation on the website: europebay.eu. The information referred to in the preceding sentence is additional and may not occupy the majority of the photo.
Z 3.11. Headings may not contain text or contact details. Promotional and advertising content relating to activities conducted outside the europebay.eu website is also prohibited. The brand/manufacturer logo and information indicating the official nature of sales conducted on the Account are permitted.
Z 3.12. Attachments to the Offer must relate to the offered item. They may not duplicate information placed in the / Description / field. The content of the attachment must be adequate to the type of selected attachment. The information contained in the attachments may not violate the other provisions of the Regulations regarding the operation on the europebay.eu website belonging to MWqp-Group UG.
Z 3.13. In an Offer covering multiple units of Goods, it is permissible to enable the selection of color or graphic design, provided that the Seller presents current information about the number of available colors or graphic designs.
Z 3.14. In the case of multi-variant Offers, it is permissible to combine Offers with Goods that have the same purpose, are of the same brand, and are listed in the same category.
5.6. The Seller undertakes to accept payments from Buyers for Transactions using all payment methods available on the europebay.eu website for the Seller's country of residence.
5.7. In addition to enabling Buyers to pay for Goods using the services referred to in Article 5.5, Sellers may also enable Buyers to pay for Goods by cash on delivery or by direct payment at the point of collection of the Goods. The handling of Buyer's cash on delivery payments is carried out in accordance with the rules provided for in the regulations of cash on delivery service providers, which the Buyer can read on the websites of the providers, including: DPD, UPS, DHL, InPost, Poczta Polska, S.A., FedEx, Canada Post and others, depending on the destination country.
5.8. The Buyer's choice of a delivery method with the option of cash on delivery payment in violation of the regulations, in particular exceeding the applicable cash payment limits, may result in the refusal to collect cash by the cash on delivery service provider.
5.9. In order to place Offers in the categories: Collections > Investment Products and Collections > Numismatics > Gold Collector Coins (excluding the subcategory: Gold and Silver Scrap), the Seller is obliged to meet the following conditions jointly:
5.9. /a. fulfill the requirements specified in Annex No. 1. Goods prohibited and conditionally allowed to the Regulations;
5.9. /b. after prior logging in to the Account under which he will publish Offers in the aforementioned categories, make a notification using the contact form available on the website https://europebay/............. and obtain acceptance of the notification from MWqp-Group UG, in the form of an e-mail sent to the User's e-mail address assigned to his Account.
5.10. MWqp-Group UG provides Buyers with a Returns Policy on the europebay.eu website, which gives them the opportunity to return Goods purchased on the europebay.eu website via an appropriate return form (hereinafter: the Form), according to the standards, conditions and rules indicated in this policy.
5.11. In connection with providing Buyers with the Returns Policy referred to in Article 5.10 above, Sellers with a Company Account or being a User conducting business activity are obliged to fully complete the appropriate form for the terms of return of Goods, located in the "Returns Conditions" tab and assign it to their Offers, and should also implement the following rules:
5.11. /a. in the event of withdrawal from the contract by the Buyer, when the Goods have not yet been sent by the Seller - refund the funds paid by the Buyers for the purchased Goods within 3 working days from the date of cancellation of the Transaction by the Buyer;
5.11. /b. in other cases of withdrawal from the contract by the Buyer, other than those specified in point a above - refund the funds paid by the Buyers for the purchased Goods within 7 calendar days from the date of receipt of the returned Goods by the Seller, but no later than 14 days from the receipt of the Form completed by the Buyer;
5.11. /c. in the event of a complaint about Goods purchased by the Buyer, who requests only a refund of the funds paid - consider the complaint within 14 calendar days from the receipt of the Form completed by the Buyer and, if the complaint is accepted in this respect, immediately refund the funds paid by the Buyers for the purchased Goods;
5.11. /d. adapt the delivery method of the returned Goods to their properties and size.

§ 6. Transaction process

6.1. By accepting the conditions presented by the Seller in the Offer content, the User, in order to purchase the Goods, participates in the Purchase by selecting the "Buy Now" option, subject to Article 3.2 of the Regulations. By performing the above actions, the User completes the appropriate form on the Offer page and confirms their choice.
6.2. Upon participating in the Purchase, personal data regarding the Buyer's Account name (login) is transferred to the Seller.
6.3. From the moment the Offer is published, Users can ask the Seller questions regarding this Offer or the Transaction that was the subject of the given Offer in the following ways:
6.3. /a. using the appropriate form /Ask the seller/ available within the Offer content,
6.3. /b. using the /Send a Message/ option within the /Message Center/ functionality available in the User's Account settings,
6.4. By proceeding with the Purchase, the purchasing User declares the price of the Goods, which they undertake to pay in case of purchase.
6.6. The proposal to conclude a contract with the Seller, by a Buyer whose Account is suspended before the end of the Offer, ceases to be binding.
6.7. The Offer ends when the time specified in its conditions by the Seller expires or when all units of the Goods are sold in Offers with the "Buy Now" option. Earlier termination of the Offer may occur:
6.7. /a. based on the Seller's decision, as referred to in Article 6.8.
6.7. /b. based on the decision of MWqp-Group UG, in the situations described in Article 8.2 point b.
6.8. The Seller may terminate the Offer at any time. In the case of:
6.8. /a. Offers with the "Buy Now" option – the sales contracts concluded so far within such an Offer are binding.
6.9. The price for the Goods should be determined in accordance with generally applicable laws. In addition to the price for the Goods, the Seller may additionally charge the Buyer only with the delivery costs indicated in the Offer in their actual amount. In the case of foreign delivery methods, additional rules apply as specified in Annex No. 3 to the Regulations.
6.10. The procedure in the event of planned technical breaks and technical failures, in particular their impact on published Offers, is specified in Annex No. 3 to the Regulations.

§ 7. Conclusion of a Contract within an Offer

7.1. IMPORTANT! MWqp-Group UG is not a party to sales contracts concluded between Users and does not guarantee that the Seller and the Buyer are entitled to conclude and perform the contract.
7.2. Concluding a contract by a User with another User whose registered office or habitual residence is not located in the European Union may result in the transaction being subject to the applicable provisions of foreign law.
7.3. The Buyer concludes a contract with the Seller by confirming the purchase using the "buy and pay" button or another button with similar meaning, subject to the provisions of Article 3.2. Each purchase and some payment methods may be additionally confirmed using biometric data from the mobile device after this function has been enabled (biometric data is stored on the device and is not shared by MWqp-Group UG).
7.4. Confirmation of the conclusion of the contract between the Buyer and the Seller is sent automatically via email (or optionally via other electronic means of communication) and is for informational purposes only. In the message referred to in the preceding sentence, the parties to the contract receive the data currently displayed in their Account settings, i.e.: name and surname, email address (encrypted by MWqp-Group UG), telephone number, address. If the Seller's registered office displayed in the Account settings is located outside the European Economic Area, the data referred to in the preceding sentence will be transferred outside the European Economic Area. If the Buyer chooses a delivery method that involves assigning a registration number to the shipment, information regarding shipment tracking may be made available to MWqp-Group UG directly by the carrier or the Seller. If the shipment number has been made available in the "Purchased" tab, visible after logging into the Account, the Buyer receives an additional email containing: the name (company) of the carrier, the shipment registration number or a link enabling its tracking.
7.5. Unless the Transaction parties agree otherwise, the Buyer, in connection with the concluded contract, should make payment for the Goods:
7.5. /a. within 7 days in the case of an Offer with the Buy Now option,
7.5. /b. within 14 days in the case of an Offer with the Buy Now option for which the Buyer has chosen a traditional bank transfer.

Failure to pay for the Goods by the Buyer within the indicated deadlines results in automatic cancellation of the Transaction by MWqp-Group UG. If the conditions for automatic cancellation of the Auction described above are not met within 30 days, MWqp-Group UG may re-verify them for this purpose. The above actions of MWqp-Group UG do not affect the civil law consequences of the conclusion of a sales contract between Users and do not release them from the obligation of mutual performance resulting from the existing legal relationship.

§ 8. The Role of MWqp-Group UG in Providing the europebay.eu Website

8.1. MWqp-Group UG is not liable for the conduct of Users within the operation of the europebay.eu website, nor for the improper performance or non-performance by them of contracts concluded within Transactions, as well as for the consequences of actions taken by Users and third parties that constitute a breach of the Terms and Conditions.
In particular, MWqp-Group UG is not liable for the quality, safety and/or legality of Goods sold within an Offer, the Sellers' ability to sell, the Buyers' solvency, or the truthfulness and accuracy of information and other content provided/transmitted by Users within the operation of the europebay.eu website.

8.2. If an Offer violates the provisions of the Terms and Conditions or applicable law, the Company may:
8.2. /a. change the category indicated by the Seller on the europebay.eu website in which the Offer is published,
8.2. /b. prematurely terminate or remove the Offer with the Buy Now option - however, contracts previously concluded within it between Users remain valid,
8.2. /c. remove the Auction, as a result of which it ceases to be available on the europebay.eu website, and any previous actions of Bidders within it have no effect,
8.2. /d. refuse to publish the Offer.

8.3. MWqp-Group UG may verify Users' compliance with the Terms and Conditions. Verification may take place in particular by checking whether Users comply with the relevant provisions of the Terms and Conditions. Verification takes place in particular by contacting the User and recording its course.

8.4. If a User's actions violate the provisions of the Terms and Conditions, MWqp-Group UG may:
8.4. /a. reprimand the User via email,
8.4. /b. issue a warning to the User via email.
Issuing a reprimand and a warning to the User does not directly result in the suspension of the User's Account or restriction of access to individual services provided within the operation of the europebay.eu website; it only constitutes information that if the User continues to violate the provisions of the Terms and Conditions, MWqp-Group UG may suspend the Account or restrict access to individual services within the operation of the europebay.eu website. In the event of repeated or material violations of the Terms and Conditions understood as:
1. The User's failure to settle dues to MWqp-Group UG within the designated timeframe,
2. The User providing incomplete or false contact information in the Account settings (e.g., name, company, address),
3. The User transferring the Account without the consent of MWqp-Group UG,
4. The User sharing the Account with other individuals contrary to the rules specified in the Terms and Conditions,
5. The User publishing Offers for prohibited Goods specified in Appendix No. 1 to the Terms and Conditions or Conditionally Allowed Goods, and the User has not met the conditions necessary for their listing, which conditions are indicated in Appendix No. 1 to the Terms and Conditions,
6. Violation of the rules regarding the listing of Offers specified in Appendix No. 2 to the Terms and Conditions,
7. Registering multiple Accounts and using them contrary to the rules specified in points 2.9 and 2.10 of the Terms and Conditions,
8. Sending spam messages to other Users,
9. A decrease in the overall quality level (within the "My Sales Quality" panel) to the value of "Needs Improvement" or "Unacceptable”

15. Violating the rules set out in § 4. Prohibited and conditionally permitted goods of these Regulations,
16. If, in the User's opinion, the services provided by MWqp-Group UG under these Regulations are not performed by the Company in accordance with the provisions of these Regulations, they may submit objections in the manner specified below (Complaint).
16. /a. Complaints can be submitted electronically via the contact form or in writing to the following address: service@europebay.eu. The complaint should include at least the name under which the User appears on the europebay.eu website (login), a description of the reported objections, and an indication of the proposed method of resolving the Complaint.
16. /b. MWqp-Group UG shall review the Complaint within 14 days of its receipt. If the Complaint does not contain the information necessary for its consideration, the Company will ask the complainant to supplement it to the necessary extent, and the 14-day period then runs from the date of delivery of the supplemented Complaint.
16. /c. The response to the Complaint is sent exclusively to the email address assigned to the User's Account. In particularly justified cases, the Company may send the response to another email address indicated by the complainant that is not assigned to the User's Account, or in writing to the address indicated in the Complaint.
16. /d. The User has the right to appeal the decision made by the Company as part of the Complaint (Appeal). The appeal may be submitted within 6 months of the User being informed of the decision by the Company.
8.4. /c. As a result of violating the rules of the regulations, in particular those resulting from the previous point 8.4. /b., MWqp-Group UG may:
Temporarily restrict the User's access to individual services provided as part of the operation on the europebay.eu website, in particular restrict, for a definite or indefinite period, the functionality of the User's Account,
Suspend for a definite or indefinite period one, several or all of that User's Accounts.

MWqp-Group UG may also temporarily restrict the User's access to individual services provided as part of the operation on the europebay.eu website or suspend for a definite or indefinite period one, several or all of that User's Accounts.

MWqp-Group UG will notify the User of the Account suspension or restriction of access to specific services via e-mail, stating the reasons for the suspension or restriction of access to the Account. In the absence of a response and submission of comprehensive explanations regarding the proper performance of the contract concluded between the Buyer and the Seller within the Discussion within 14 days, MWqp-Group UG may make the use of functions on the europebay.eu website dependent on the User confirming the fact of fulfilling the contract concluded as a result of the Transaction.
